EDUCATIONAL SUPPORT SYSTEM
Policy
It is the policy of the _________________School District to provide a continuum
of educational services through a comprehensive Educational Support System to
increase the ability of the school to meet the needs of all students in the
general education environment.
This
policy will comply with the requirements of 16 V.S.A. §§ 2901, 2902 and 2904,
and Rules 2194 and 2120.8.3 of the Vermont State Board of Education.
Implementation[2]
The superintendent (or principal) shall be responsible for developing written
procedures[3]
to establish and implement the educational support system. The procedures shall comply with the
requirements of Act 117 of 2000 and State Board of Education Rules 2194 and
2120.8.3.[4]

[1] State Board of Education Rule 2194(1) requires that “…each public school board in Vermont shall adopt a policy that establishes and educational support system.
[2] State Board of Education Rule 2194(2) requires that “…each public school develop written procedures to establish and implement the education support system. The procedures shall describe:
(a) the composition and function of the educational support team; and
(b) a process for timely referral for evaluation for special education eligibility when warranted. The education support system shall not be a substitute for the special education process and shall not interfere with a student’s right to a timely referral for an evaluation for special education eligibility at any time prior to or during the conduct of educational support activities.

V.S.A. §563(1) provides in part: “A school board may…approve or
disapprove rules and regulations proposed by the principal or superintendent
for the conduct and management of public schools in the district.” (Emphasis added)

Rule 2194.2 requires that “…the educational support system
shall, at a minimum, include an educational support team and a range of support
and remedial services, including instructional and behavioral interventions and
