Part 1: Introduction
to Act 82
Act 82
requires some school districts to present a school district budget proposal in
two questions.
Act 82 is
effective for the fiscal years 2010 - 2014.
Act 82
affects school districts that fit both the following criteria:

districts are above average
Part 2: The Maximum
Inflation Amount
·
The
“MIA” is a maximum amount of education spending that affected districts will be
allowed to present as one question.
·
Districts
that did not spend above average in FY2009 do not have an MIA for FY2010.
o They can present any amount of
spending in one question.
Part 3: Education
Spending
·
Education
Spending is not all school
spending. The MIA only limits Education
Spending.
·
Spending
that is offset by local revenues (like Title 1 Funds or other grants or
reimbursements) does not count towards the MIA.
·
Education
spending per pupil determines the district’s education property tax rate
·
Along
with the district’s CLA
Part 4: The MIA Formula
Step 1. Statewide average education
spending per equalized pupil in FY2009
MULTIPLIED BY
An inflation factor + 1%.
THIS YEAR:
$11,599.24 * (2.9% + 1%) =
$452.37
Step 2. Add that amount to your
district’s FY2009 education spending per pupil.
For Randolph Union High School:
$12,539.46 + $452.37 = $12,991.83
Step 3. Finally, multiply that number
by the district’s equalized pupils in either
FY2009 or FY2010 (whichever is larger).
$12,991.83 * 536.02 = $6,963,881
Randolph UHS FY2010 MIA = $6,963,881
Part 5: Hypothetical

Randolph’s Local Revenue: $500,000
Randolph’s Proposed Ed. Spending:

Part 7: Special
Articles
DOE
Interpretation of Act 82:
If
a district is subject to the MIA, and proposes several articles that, added
together, exceed the MIA, those articles would not be allowed.
Must
use Question 1, Question 2 format.
For
other districts, special articles will still be allowed.
Part 8: Authorizing
Articles
DOE Interpretation of
Act 82:
Additional
ballot articles will be allowed when no new money is being expended.
Example:
“Shall the voters of the School
District approve depositing $25,000 of the approved budget into a reserve
fund?”

MIAs
Note: These are estimates only! DOE will provide official figures.
To calculate
a district’s MIA, locate the district in column A, and note the corresponding
per pupil MIA estimate in column C.
Multiply the figure in column C by equalized pupils in the
district. Remember you can use equalized
pupils from FY2009 or FY2010, whichever is larger.
If a district
is not listed below, it did not spend above average in FY2009 and is not
subject to the two-vote law this year.
